1. ACCEPTANCE OF TERMS
By downloading, installing, and using LED Banner Pro: Text, you agree to be bound by these Terms of Service. If you do not accept these terms, do not use this App.
We reserve the right to modify these terms at any time. Continued use of the App constitutes acceptance of modified terms.
2. LICENSE AND USE
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only, subject to Apple's Standard End User License Agreement (EULA) at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
3. FEES AND IN-APP PURCHASES
LED Banner Pro is free to download and use. We offer optional in-app purchases ("Pro") that unlock additional features such as custom LED bitmap fonts and music-sync strobe.
- Where offered, a weekly auto-renewing subscription and/or a one-time lifetime unlock may be available; pricing is shown at the point of purchase and may vary by region.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your Apple ID account settings.
- All purchases are processed through Apple's App Store via StoreKit and are subject to Apple's terms and payment policies.
- Purchases are final; refund requests must be submitted to Apple in accordance with Apple's refund policies, as we do not have the ability to directly issue refunds.
4. STROBE LIGHT SAFETY
The App includes an adjustable-frequency strobe light and screen flasher. Flashing lights may trigger seizures in individuals with photosensitive epilepsy or similar conditions. If you or anyone nearby has a history of seizures, use the strobe and disco-screen features with caution or avoid them entirely. You are responsible for using these features safely and lawfully (for example, not using the strobe or SOS torch in a way that could distract drivers or emergency services).
5. USER RESPONSIBILITIES
You agree NOT to use the App to:
- Violate laws or regulations
- Infringe on intellectual property rights
- Transmit malware or harmful code
- Harass, threaten, or endanger others
- Disrupt App functionality or reverse engineer the App except where permitted by law
6. INTELLECTUAL PROPERTY
The App, including all content, features, and functionality, is owned by us or our licensors. You may not use our intellectual property without express written permission. All rights are reserved.
7. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and that the App will be error-free or uninterrupted. Some jurisdictions do not allow disclaimer of implied warranties; in such cases, the above disclaimer applies only to the extent permitted by law.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data or use, arising from your use of, or inability to use, the App, including any use of the strobe light or torch features. This limitation applies even if we have been advised of the possibility of such damages.
9. THIRD-PARTY SERVICES
The App uses Apple's StoreKit for purchases. Apple's terms and privacy policy apply to your use of that service.
10. TERMINATION
We may terminate or suspend your access if you violate these Terms. Upon termination, your right to use the App ceases immediately. You may stop using the App at any time by deleting it from your device.
11. GOVERNING LAW
These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles.
12. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions remain in full force and effect.
